1. Acceptance of Terms
By downloading, installing, or using SkyReady ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app. These Terms constitute a legal agreement between you and Tim Dalton Software ("we," "us," or "our").
2. Description of Service
SkyReady is a weather application for iOS that provides:
- Current weather conditions based on your location
- Clothing and accessory recommendations (jacket, umbrella) based on weather data
- Daily morning weather notifications at a time you choose
- 7-day weather forecast
- Weather animations and visual indicators
Additional features are available through an optional paid subscription (SkyReady+), as described in Section 5 below.
Weather data is provided by Apple WeatherKit. Forecasts and recommendations are informational and should not be relied upon as the sole basis for safety-critical decisions.
3. Eligibility
SkyReady is available to anyone who can form a binding contract under applicable law. The app is rated 4+ and does not contain age-restricted content. There is no minimum age requirement beyond what is imposed by Apple for App Store access.
4. User Responsibilities
By using SkyReady, you agree to:
- Use the app only for its intended purpose of viewing weather information and recommendations
- Not attempt to reverse-engineer, decompile, or disassemble the app
- Not use the app in any manner that could damage, disable, or impair the service
- Not attempt to gain unauthorised access to any systems or networks connected to the app
- Comply with all applicable laws and regulations in your use of the app
5. Subscription Terms (SkyReady+)
5.1 Subscription Options
SkyReady+ is an optional premium subscription that provides additional features including home screen widgets, extended 14-day forecast, precipitation alerts, multiple location tracking, and custom themes.
Two subscription plans are available:
- Monthly: $0.99 per month
- Annual: $9.99 per year
Prices are in US dollars. Pricing in other currencies is determined by Apple based on current exchange rates and local pricing tiers.
5.2 Free Trial
Both subscription plans may include a 7-day free trial. If you do not cancel before the free trial ends, you will be automatically charged at the applicable subscription rate. Any unused portion of a free trial period will be forfeited when you purchase a subscription to SkyReady+.
5.3 Payment and Billing
Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
5.4 Managing Your Subscription
You can manage your subscription and turn off auto-renewal by going to your Account Settings in the App Store after purchase. You can also manage subscriptions through Settings > [your name] > Subscriptions on your device.
5.5 Cancellation and Refunds
You may cancel your subscription at any time by turning off auto-renewal through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until the end of your paid period.
Refunds are handled by Apple in accordance with Apple's refund policies. To request a refund, visit reportaproblem.apple.com or contact Apple Support. We do not process refunds directly.
5.6 Price Changes
We may change subscription pricing at any time. If we increase pricing, Apple will notify you in advance and you will have the opportunity to accept the new price or cancel your subscription. Price changes will not apply to your current billing period.
5.7 Family Sharing
SkyReady+ supports Apple Family Sharing. If you subscribe and have Family Sharing enabled, members of your family group may also access premium features at no additional cost, subject to Apple's Family Sharing terms.
6. Intellectual Property
6.1 Ownership
SkyReady, including its design, code, graphics, animations, user interface, and content, is owned by Tim Dalton Software and is protected by copyright, trademark, and other intellectual property laws.
6.2 Licence Grant
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app on any Apple device you own or control, subject to the App Store Terms of Service and these Terms.
6.3 Restrictions
You may not:
- Copy, modify, or distribute the app or any part of it
- Create derivative works based on the app
- Use the app's name, logo, or branding without written permission
- Remove, alter, or obscure any copyright or proprietary notices in the app
7. Weather Data and Accuracy
7.1 Data Source
Weather data displayed in SkyReady is sourced from Apple WeatherKit. We do not generate weather forecasts independently.
7.2 No Guarantee of Accuracy
Weather forecasts are inherently uncertain. We do not guarantee the accuracy, completeness, or reliability of any weather data or recommendation displayed in the app. Clothing recommendations are provided as general guidance based on forecast conditions and should not be relied upon for safety-critical decisions.
7.3 Not a Safety Service
SkyReady is not a severe weather warning service. Do not rely on SkyReady as your sole source of weather information during severe weather events. Always monitor official weather services and emergency alerts from your local authorities.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY WEATHER DATA OR RECOMMENDATIONS PROVIDED BY THE APP.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TIM DALTON SOFTWARE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE APP EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR TEN US DOLLARS ($10.00), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify, defend, and hold harmless Tim Dalton Software from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the app or your violation of these Terms.
11. Third-Party Services
SkyReady relies on Apple WeatherKit for weather data, Apple StoreKit for subscription management, and Mixpanel for product analytics. Your use of Apple services is subject to Apple's own terms and conditions. Mixpanel's terms are available at mixpanel.com/legal/terms-of-use. We are not responsible for the availability, accuracy, or performance of third-party services.
12. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the app or any feature at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the app.
13. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the app after changes are posted constitutes acceptance of the updated Terms.
14. Termination
We may terminate or suspend your access to the app at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the app will immediately cease.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be resolved in the courts of England and Wales, and you consent to the jurisdiction of such courts.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tim Dalton Software regarding the use of SkyReady.
